DMCA Takedown Policy
Digital Millennium Copyright Act Notice & Takedown Procedures
NXT Basketball respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond promptly to claims of copyright infringement committed using our platform.
1. Filing a DMCA Takedown Notice
If you believe that content hosted on our platform infringes your copyright, please submit a written notification containing the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved).
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., a URL or description).
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
2. Where to Send Notices

3. Our Response
Upon receiving a valid DMCA takedown notice, we will:
- Remove or disable access to the allegedly infringing material promptly.
- Notify the user who posted the content that it has been removed.
- Provide the user with information about how to file a counter-notification if they believe the takedown was in error.
4. Counter-Notification
If you believe that material you posted was removed by mistake or misidentification, you may file a counter-notification containing:
- Your physical or electronic signature.
- Identification of the material that was removed and the location where it appeared before it was removed.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Washington State if you are outside the United States).
5. Repeat Infringers
In accordance with the DMCA, we will terminate the accounts of users who are determined to be repeat infringers. We define a repeat infringer as any user who has been the subject of more than two valid DMCA takedown notices.
6. Content Involving Minors
Our platform serves youth sports programs and may contain photos and videos of minor athletes. If you are a parent or guardian and believe that content featuring your child has been posted without your consent, please contact us immediately at dmca@northkitsapnxt.com. We take the privacy and safety of minors extremely seriously and will expedite the removal of any such content.
7. Good Faith & Misrepresentation
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be subject to liability. Please ensure that you have a good faith basis for any claim before submitting a DMCA notice or counter-notification.
